The Vitebsk Regional Control Committee in 2012 identified 32 legal entities violating foreign trade operations procedures
In 2012, employees of the Vitebsk Regional Committee for State Control and the Department of Financial Investigations identified 32 legal entities violating the procedure for conducting foreign trade operations, the control authority informed BELTA.
According to the controllers, with violation of the deadline for export operations, 28.9 million Russian rubles, 23.2 thousand euros, and $64.7 thousand were received; the inflow of currency in the amount of 51.2 million Russian rubles, 25 thousand euros, and $288.2 thousand was not ensured; payment in the amount of Br192.2 million for services rendered to non-residents was not received. With exceeding the established deadlines, goods were imported in the amount of 5.8 million Russian rubles and 2.4 million euros. The inflow of imported goods worth Br879.7 million and 353.5 thousand euros was not ensured.
For example, an inspection of the Orsha Flax Mill found that for 15 foreign trade operations, the timely inflow of funds for export or the completion of foreign trade operations in another way provided for by legislative acts in the total amount of 10.5 million Russian rubles and $54.2 thousand was not ensured. Facts of exceeding the completion deadlines for 34 foreign trade operations in export were identified at the joint Belarusian-Russian enterprise "Belvest".
An inspection of OJSC "Orsha Meat Canning Plant" revealed the failure to fully complete foreign trade operations within the period established by law when exporting to entities of the Russian Federation for goods shipped back in 2009-2010, with a total amount of 12.8 million Russian rubles, or to terminate obligations in another manner provided for by law. The funds have not been returned to date. The State Control Committee noted that according to the company's charter, approved by the general meeting of shareholders, the decision on supplying products outside the Republic of Belarus without prepayment falls within the competence of the company's directorate, whereas directorate meetings on these issues were not held. The signing of contracts that did not provide for prepayment, as well as amendments to contracts regarding changes in payment terms - from prepayment to deferred payment - were carried out by officials of OJSC "Orsha MCP" exceeding their authority. Based on these facts, in 2012, a criminal case was initiated against the Deputy General Director for Marketing and Sales on the grounds of an offense provided for by Part 3 of Article 426 of the Criminal Code of the Republic of Belarus (abuse of power or authority).
In total, in 2012, for violations committed during foreign economic activities, 27 legal entities were brought to administrative responsibility in the form of fines totaling Br12,498.3 million, and 24 individuals - in the amount of Br5.5 million. Administrative fines totaling Br1.8 billion were recovered from legal entities, and Br4.3 million from individuals.
