The number of appeals to the Vitebsk Regional Economic Court in 2010 decreased by 4% to 14.8 thousand.
January 14, Vitebsk / Sergey Kochetov - BELTA/. The number of applications to the economic court of the Vitebsk region in 2010 was about 14.8 thousand, a decrease of 4% compared to 2009, the head of the court's judicial practice department, Olga Kibisova, told a BELTA correspondent.
The amount of claimed recovery claims amounted to almost Br360 billion, of which 88% were recovered in favor of the applicants based on the results of case reviews. It is worth noting that in the simplified procedure for case reviews (order production), Br267 billion was ordered for recovery, which is 6 times higher than the amount of recovery in the claim procedure. Based on the court's work, over Br4.1 billion of state duty was received by the republican budget.
Among the cases reviewed by the court in the claim procedure, 96% were property disputes, the vast majority of which were cases of non-fulfillment or improper fulfillment of contractual obligations by economic entities. At the same time, in 2010, the trend of an increasing number of non-property disputes continued, their number increased by more than 20% to 367 cases. Thus, the number of cases related to the complex category of disputes increased, namely, on the conclusion, amendment and termination of contracts (an increase of more than 30% to 55 cases), on the recognition of transactions as invalid or void (doubled to 37 cases).
In the structure of non-property disputes, about 20% were cases on the invalidation of non-normative acts of state and other bodies, while their number increased by 37% compared to 2009. Most often, acts of tax inspectorates (16 cases), executive and administrative bodies (13 cases), and customs authorities (13 cases) were appealed in court. In 24 cases, or 32% of the total number of such disputes, the court made decisions on full or partial satisfaction of the claimed requirements.
In the total number of received applications, the share of claim applications was 62.8% (almost 9.3 thousand), the share of applications in order production accounted for about 23% (almost 3.4 thousand), and administrative cases accounted for 11.7% (1.7 thousand). -0-
