The Ministry of Justice of Belarus notes insufficient control over the enforcement of court decisions

August 7, Minsk /BELTA/. The Ministry of Justice of Belarus notes the insufficient organization of the activities of justice bodies and courts in controlling the execution of decisions of courts and other bodies. This was reported to BELTA by the Ministry of Justice. During the inspections carried out by the Ministry of Justice, serious shortcomings were revealed in the work of the courts in this area: procrastination in carrying out enforcement actions, a formal attitude of bailiffs to their official duties, indifference to these issues on the part of court chairmen, gross violation of the requirements of the legislation regulating enforcement proceedings, which leads to a decrease in their performance indicators, as well as to justified appeals from citizens and legal entities. "This indicates that many court chairmen do not pay due attention to the activities of bailiffs, and control is formal in nature," the Ministry of Justice states. For example, over the past five years, the rate of recovery of fines imposed in cases of administrative offenses by bailiffs has decreased from 58% to 46%. "These facts are particularly intolerable in the context of the current economic relations," the Ministry of Justice noted. For improper organization of work and control over the execution of decisions of courts and other bodies, the Ministry of Justice has brought to disciplinary responsibility the heads of some main departments of justice of regional executive committees, the Minsk City Executive Committee, and senior bailiffs of a number of courts. The main departments of justice have been instructed to consider the issue of bringing to disciplinary responsibility the chairmen of a number of courts that have allowed serious shortcomings in this work. The Ministry of Justice has outlined additional measures to increase the responsibility of the management of the main departments of justice and court chairmen. In the future, strict disciplinary measures, up to dismissal from office, will be taken against court chairmen and judges who show indifference to the performance of their official duties in controlling the execution of enforcement documents, the Ministry of Justice emphasized. In addition, it was deemed expedient to submit a proposal to the authorized state bodies to establish criminal liability for debtors for evading the fulfillment of monetary obligations imposed on them by the court. -0-
