The Vitebsk Regional Prosecutor's Office has identified violations of legislation in environmental protection inspectorates
June 15, Vitebsk / Sergey Kotovets - BELTA /. The Vitebsk Regional Prosecutor's Office has identified instances of incorrect qualification of offenders' actions and unjustified bringing of citizens to administrative responsibility in the structural divisions of the regional committee for natural resources and environmental protection. This was reported to a BELTA correspondent by Valentina Khodosevich, Senior Assistant Prosecutor of the region for supervision of environmental legislation enforcement.
During the inspection of environmental protection inspectorates, violations of the requirements of the legislation regarding the content of protocols and decisions on bringing guilty persons to responsibility were most frequently identified. Thus, the procedural documents lacked information about the persons who drew them up, the deadlines for appeal, as well as the parts and articles of the Code of Administrative Offenses under which the guilty parties were brought to administrative responsibility. In some cases, the circumstances of the offenses were not even indicated. Numerous errors were found in the protocols when citing the regulatory legal acts for the violation of which the guilty parties were brought to responsibility, including references to non-existent and repealed laws.
The consequence of such violations was the incorrect qualification of offenders' actions and the unjustified bringing of citizens to responsibility, which were identified, in particular, in the Sharkovshchyna, Tolochin, and Glubokoye district inspectorates.
In addition, the structural divisions of the regional committee for natural resources, in a number of cases, failed to take adequate measures to recover material damages from violators of environmental legislation. The identified violations indicate a lack of control over the timely submission of applications to the courts for the compulsory recovery of administrative fines. In a number of inspectorates, the quality of the orders issued by officials of the environmental department to offenders is suffering. Often, orders were issued without conducting inspections and proper legal justification. At the same time, control over the execution of the issued orders is also not properly established.
Based on the results of the inspection, the regional prosecutor's office prepared 33 response acts, including more than 20 submissions, to eliminate the identified violations of the legislation. 16 officials of the inspectorates were brought to disciplinary responsibility, including the heads of the Chashnikskaya, Orshanskaya, Sennenskaya, Dokshitskaya district inspectorates and the Vitebsk city inspectorate.-0-
