As of March 1, amendments to the Code of the Republic of Belarus "On Administrative Offenses" have come into force

Specifically, amendments have been made to the articles providing for liability for violation of the legislation on the State Border of the Republic of Belarus, reported Denis Glebko, an official representative of the Polotsk Border Guard Detachment.

Article 24.19 of the Code of the Republic of Belarus on Administrative Offenses - Violation of the border regime (previously Article 23.30 as amended by the code of 2003) divides the types of liability for violation of the border regime in the border zone and in the border strip, as well as for an attempt to commit such an act.

Separate additions have been made to Article 24.56 - Illegal entry of persons into the Republic of Belarus (previously Art. 23.87 as amended by the code of 2003), which establishes liability for the illegal entry of persons into the Republic of Belarus.

We draw special attention to the fact that in case of failure by an individual driving a vehicle to take measures to prevent the delivery to the territory of the Republic of Belarus of a foreign citizen or a stateless person permanently residing outside the Republic of Belarus, who do not have the documents necessary for entry into our country, there is now liability in the form of a fine of up to twenty basic units – up to 580 Belarusian rubles.

For example, a private individual engaged in transporting citizens in a personal car upon entering Belarus, during passenger boarding, did not ensure that they had valid documents for crossing the state border (for example, the passenger's passport may have expired, or be damaged (destroyed) pages, or be missing individual pages). In case of detection of such persons during border control, the driver may be subject to administrative liability for the illegal entry of persons into the Republic of Belarus in the form of a fine of up to 580 rubles.

We also inform you that a chapter has now been introduced, which enshrines the types of preventive measures against violators of the law. These measures are not administrative penalties; they include:

1. Oral remark. It consists in explaining to an individual the unlawful nature and public harm of the administrative offense committed by them, and warning them against unlawful behavior on their part.
2. Warning, which consists of a written warning to the person who committed the administrative offense, as well as about the inadmissibility of unlawful behavior on their part and the legal consequences in case of repeated commission of this administrative offense.
3. Educational measures. They are applied to minors who have committed an administrative offense.
These include:
explanation of legislation;
imposing an obligation to apologize to the victim;
imposing an obligation to compensate for the harm caused;
leisure restrictions.
